1. Your Memories Belong to You

Let’s start with the most important part.

Pictagraff does not claim ownership of your photos, your handwritten messages, or the completed images you create using the app.

Your memories are yours.

Pictagraff simply gives you the tools to capture, sign, and save them.

Nothing in these Terms gives Pictagraff Studios LLC ownership of the personal content you create with the app.

2. Using Pictagraff

You may use Pictagraff for personal and other lawful purposes.

That might mean capturing an autograph from someone you admire, adding a handwritten message to a family photograph, preserving a note from someone you love, or creating something we never imagined when we built the app.

That’s part of what makes Pictagraff special.

We only ask that you use it responsibly and lawfully.

You may not use Pictagraff to commit fraud, impersonate another person, forge a signature, violate someone’s rights, or engage in unlawful activity.

3. Photos, People, and Permission

Pictagraff makes it possible to photograph people and add handwritten content or signatures to those photographs.

Pictagraff cannot determine whether you have permission to take, use, share, publish, or distribute a particular photograph, message, or signature.

You are responsible for obtaining any permission that may be required.

Please respect the people whose moments you are helping preserve.

4. Signatures and Handwritten Content

A signature can be meaningful. It can also have legal significance outside Pictagraff.

Pictagraff is designed to preserve handwriting and signatures as part of an image.

Pictagraff is not an electronic-signature service, identity-verification service, authentication service, or legal document-signing service.

Pictagraff Studios LLC does not verify that a signature is genuine and does not certify the identity of the person who created it.

The fact that a signature appears in an image created using Pictagraff does not, by itself, prove that the signature is authentic or that a particular person created it.

You may not use Pictagraff to forge signatures, impersonate another person, commit fraud, or falsely represent that someone signed or approved something they did not.

5. Sharing What You Create

Once you save a completed image, it is stored on your device and is under your control.

If you choose to text it, email it, print it, post it online, move it to another device, back it up, or share it in another way, that decision is yours.

Pictagraff Studios LLC does not control what happens to an image after you choose to share it.

Before sharing something containing another person’s photograph, handwriting, or signature, please consider whether you have their permission and whether sharing it could affect their privacy or other rights.

6. General Audience and Families

Pictagraff is a general-audience app designed to help people preserve photographs, signatures, handwritten messages, and memories.

Pictagraff is not designed specifically for children. However, we recognize that families may choose to let children use it.

The core Pictagraff experience does not require an account or password, and Pictagraff does not collect personal information through the core app.

We encourage parents and guardians to talk with children about asking permission before photographing people and being thoughtful about when and where photographs should be shared.

If you’re a parent or guardian and would like to understand how Pictagraff handles your family’s privacy, please read our Privacy Policy. We’ve written it in plain language for exactly that reason.

Our promise remains simple: Your memories should stay yours.

7. Intellectual Property

What you create is yours. Pictagraff itself is ours.

You keep your rights to the photographs, handwritten messages, and other original content you create and have the right to use.

Pictagraff Studios LLC retains its rights in the Pictagraff app and brand, including its software, source code, design, name, logos, graphics, and other materials created by Pictagraff Studios LLC.

Using Pictagraff does not give you ownership of our software or brand.

Likewise, using Pictagraff does not give you rights to somebody else’s photographs, artwork, trademarks, copyrighted material, signatures, or other intellectual property.

Please respect other people’s creations just as we respect yours.

8. Saving and Protecting Your Memories

Pictagraff is designed to save your images to your device.

Technology, unfortunately, isn’t perfect.

Devices can fail. Storage can become full. Files can be accidentally deleted. Phones get lost. Permission settings can change. Operating-system updates and hardware problems can sometimes cause unexpected behavior.

For memories that are especially important to you, we strongly encourage you to maintain your own backups.

Because Pictagraff does not keep copies of your memories on company servers, we cannot recover a photograph or completed image that has been lost from your device or backups.

Pictagraff Studios LLC cannot guarantee that every photograph or completed image will always be successfully saved, retained, or recoverable.

There’s a tradeoff to keeping your memories private and under your control: you control the backups too.

9. Updates, Features, and Purchases

We’ll continue working to improve Pictagraff.

That may mean fixing bugs, improving compatibility, refining existing features, or adding new ones.

Our goal is to keep Pictagraff simple, useful, and true to the reason it was created.

Some future features, upgrades, or versions may require a purchase. If they do, the price and applicable purchase information will be shown before you choose to buy them.

Buying an optional feature or upgrade does not give Pictagraff Studios LLC ownership of the memories you create with it.

10. Availability

We’ll do our best to keep Pictagraff working properly.

We cannot promise that Pictagraff will operate without interruption, bugs, errors, or compatibility problems on every device or every future version of Android.

Technology changes, and sometimes Pictagraff may need to change with it.

The app or particular features may occasionally need to be updated, modified, suspended, or discontinued.

11. Pictagraff Is Provided “As Is”

To the extent permitted by applicable law, Pictagraff is provided on an “as is” and “as available” basis.

We cannot guarantee that the app will meet every possible purpose, operate perfectly on every device, or always produce the result you expect.

Nothing in these Terms takes away rights or protections that cannot legally be waived under applicable law.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Pictagraff Studios LLC will not be responsible for indirect, incidental, special, consequential, or similar damages resulting from the use of, or inability to use, Pictagraff.

This includes, where permitted by law, losses resulting from photographs or files that are lost, damaged, deleted, or unavailable because of device failure, storage problems, operating-system changes, user actions, third-party services, or circumstances outside Pictagraff Studios LLC’s reasonable control.

Some jurisdictions do not allow certain exclusions or limitations of liability. Where those laws apply, these limitations apply only to the extent permitted by law.

13. If Something Goes Wrong

If you discover a problem with Pictagraff, we’d rather hear about it than leave you frustrated.

Please contact us and give us a reasonable opportunity to understand the problem and help where we can.

We can’t promise every problem can be fixed.

But we’ll treat you like a person, not a ticket number.

14. Changes to These Terms

As Pictagraff grows, these Terms may occasionally need to change.

When they do, we’ll update the effective date at the top of this document.

If a future change materially affects how Pictagraff works or our relationship with our users, we’ll make reasonable efforts to explain the change clearly.

We don’t believe important changes should be hidden in legal fine print.

15. Governing Law

These Terms are governed by the laws applicable to Pictagraff Studios LLC in the State of Idaho, United States, without taking away consumer rights that applicable law gives you where you live.

Terms of Use usually aren’t anyone’s favorite reading material.

Pictagraff started with a simple idea: a way to capture a photograph and preserve someone’s signature with it. Along the way, we realized it could mean much more.

A handwritten note from someone you love. A message from a parent or grandparent. A child’s handwriting. An autograph from someone you admire. Or simply a few handwritten words that become more meaningful as the years pass.

That’s why we believe the handwriting can matter just as much as the photograph.

We want Pictagraff to make money and become a successful business. But we believe there are right ways and wrong ways to get there.

Your memories aren’t inventory. Your personal information isn’t a product. And your trust isn’t something we’re willing to trade for an easy dollar.

We’ll make mistakes. We’re human. When we do, we’ll try to make them right.

And no matter how Pictagraff grows, we’ll keep coming back to the principle that started all of this:
